Article 62. Professional development of a civil servant

1. The professional development of a civil servant is aimed at maintaining and improving the level of qualification of civil servants necessary for the proper performance official duties, and includes additional vocational education and other activities to professional development.

2. The professional development of a civil servant is carried out during the entire period of his civil service.

3. The grounds for sending a civil servant to participate in professional development activities are:

1) the decision of the representative of the employer;

2) the results of certification of a civil servant;

3) appointment of a civil servant to another civil service position in accordance with paragraph 2 of part 1 of article 31 of this Federal Law;

4) appointment of a civil servant in the order of promotion to a civil service position of the category "heads" of the highest or main group of civil service positions or to a civil service position of the category "specialists" of the highest group of civil service positions for the first time;

5) admission of a citizen to the civil service for the first time.

4. The implementation of measures for the professional development of a civil servant can be carried out:

1) through the state order for activities for the professional development of civil servants in accordance with the law Russian Federation about contract system in the field of procurement of goods, works, services to meet state and municipal needs;

2) within the framework of a state task in the manner established by the Government of the Russian Federation or regulatory legal acts of a constituent entity of the Russian Federation;

3) at the expense of the state body, in which the civil servant replaces the position of the civil service, in the organization that carries out educational activities for additional professional programs determined in the manner established by the legislation of the Russian Federation on the contract system in the field of procurement of goods, works, services to meet state and municipal needs.

5. Measures for the professional development of a civil servant may be carried out outside the territory of the Russian Federation.

6. Measures for the professional development of a civil servant are carried out with or without separation from the civil service.

7. The professional development of a civil servant is carried out in the manner determined by the President of the Russian Federation.

8. A civil servant participating in professional development activities, a representative of the employer, educational organization, state body or other organization creates conditions for professional development.

9. Additional professional education of a civil servant includes professional retraining and advanced training.

10. Additional professional education of a civil servant is carried out in organizations engaged in educational activities for additional professional programs, including on the basis of a state educational certificate for additional professional education of a civil servant (hereinafter referred to as the certificate).

11. The procedure for issuing a certificate, the form of the certificate, the rules for filing an application for the issuance of a certificate and the rules for issuing a certificate (its duplicate) are established by the Government of the Russian Federation.

Types of additional professional education. system law public service establishes that retraining, advanced training and internships for civil servants are carried out in accordance with federal laws and other regulatory legal acts of the Russian Federation, as well as subjects of the Russian Federation.

According to the Civil Service Law, one of the rights of a civil servant is his right to additional professional education, which includes: professional retraining, advanced training and internships.

Professional retraining - is the receipt by civil servants additional knowledge, skills and abilities in educational programs that provide for the study of individual disciplines, sections of science, engineering and technology necessary to perform a new type of professional activity.

Training - this is an update of the theoretical and practical knowledge of specialists in connection with the increased requirements for the level of qualifications and the need to master modern methods for solving professional problems. It is carried out as needed, but at least once every three years.

Internship- this is a procedure for the formation and consolidation in practice of professional knowledge, skills and abilities obtained as a result of theoretical training. The internship is also carried out for the purpose of studying excellence, acquiring professional and organizational skills to fulfill the duties of a job or more high office. Internship is as an independent type of additional vocational education civil servant, as well as part of his professional retraining or advanced training.

Normative legal acts on the features of certain types of public service may provide for other types of additional professional education of civil servants.

For example, the order of the Ministry of Internal Affairs of Russia dated June 29, 2009 No. 490 approved the Instruction on the organization of professional training for employees of the internal affairs bodies of the Russian Federation. According to this document, training camps are the type of vocational education in the system of the Ministry of Internal Affairs of Russia. Their goal is to increase the professional readiness of employees of internal affairs bodies to perform operational and service tasks in their current or new positions.

State order for professional retraining, advanced training and internship. Professional retraining and advanced training of a civil servant are carried out in state-accredited educational institutions of higher vocational and secondary vocational education that have the right to issue a state document on the corresponding level of education, to use a seal depicting the State Emblem of the Russian Federation, as well as the right to be included in the scheme of centralized government funding. The internship of a civil servant is carried out directly in state bodies and other organizations.

Organization of professional retraining, advanced training and internships for civil servants carried out on the basis of a state order, which is formed taking into account the programs of state bodies for the professional development of civil servants, based on their individual plans for professional development .

Such a plan is developed by the civil servant himself together with the immediate supervisor for a period of three years. The individual plan specifies:

    the purpose, type, form and duration of additional professional education, including information about the possibility of using distance learning technologies and self-education;

    directions of additional professional education;

    expected performance.

The program of the state body for the professional development of civil servants approved by its head in agreement with the relevant state body for the management of the civil service. In the three year program:

    the annual need for professional retraining, advanced training and internships for civil servants is forecasted for categories and groups of civil service positions, areas, types, forms and duration of additional professional education, taking into account the profile and type of educational institutions;

    the stages of the program implementation, the list of activities, as well as indicators that allow evaluating the progress and results of its implementation are indicated;

    expected performance. Federal state bodies no later than March 1 of the year preceding the planned one submit applications for the training of civil servants to the federal state body for public service management. An explanatory note with the rationale for the main directions of additional professional education is attached to the application.

On the basis of such applications, the federal state body for the management of the civil service determines the structure of the state order for professional retraining, advanced training and internships for federal civil servants and calculates the amount of its funding.

Not later than May 1 of the year preceding the planned one, proposals agreed with the Administration of the President of the Russian Federation are submitted to the Government of the Russian Federation:

on the amount of financing of the state order for professional retraining, advanced training and internship of federal civil servants for the corresponding year with the necessary justifications;

on the priority areas of additional professional education for federal civil servants based on the long-term goals and objectives of the federal state bodies.

The state order is approved by the Government of the Russian Federation no later than three months from the date of entry into force of the federal law on federal budget for the respective year.

Placement of the specified state order is carried out in the manner prescribed by federal law dated July 21, 2005 No. 94-FZ “On placing orders for the supply of goods, performance of work, provision of services for state and municipal needs”, on a competitive basis.

The federal state body (customer), together with the federal state body for public service management, on the one hand, and the relevant educational institution, on the other hand, conclude a state contract for professional retraining or advanced training of federal civil servants.

The procedure for retraining, advanced training and internships. The procedure for retraining, advanced training and internships for civil servants is regulated by Decree of the President of the Russian Federation dated December 28, 2006 No. 1474 “On additional professional education for civil servants of the Russian Federation”.

The grounds for sending a civil servant for professional retraining, advanced training or internship are:

    appointment of a civil servant in the order of promotion to another civil service position on a competitive basis;

    inclusion of a civil servant in the personnel reserve to fill a civil service position on a competitive basis;

A civil servant may also receive additional professional education abroad.

Professional retraining and advanced training of civil servants replacing civil service positions of the category "leaders" belonging to the highest group of positions are carried out with a break, with a partial break or without a break from the civil service and using the possibilities of distance learning technologies.

Professional retraining and advanced training of civil servants replacing civil service positions of the category "assistants (advisers)" or "specialists" belonging to the highest group of positions, as well as civil service positions of the category "leaders", "assistants (advisers)", "specialists" or "providing specialists" related to the main and leading groups of positions are carried out with separation or partial separation from the civil service.

Professional retraining and advanced training of civil servants, replacing other civil service positions are carried out with separation from the civil service.

The internship of civil servants is carried out with a separation from the state civil service.

The passage of professional retraining, advanced training or internship by a civil servant is confirmed by the relevant document of the state standard and is the primary basis for the inclusion of a civil servant in personnel reserve on a competitive basis or continuing to replace a civil servant with a civil service position.

Decree of the Government of the Russian Federation of May 6, 2008 No. 362 approved state requirements for professional retraining, advanced training and internships for civil servants of the Russian Federation.

Requirements for professional retraining of civil servants. Professional retraining is carried out in order to improve the knowledge of civil servants or to obtain additional knowledge for them to perform a new type of professional activity obtaining additional qualifications.

For vocational retraining, the following normative terms of development educational programs :

    for civil servants to perform a new type of professional activity - more than 500 classroom hours;

    for civil servants to obtain additional qualifications - more than 1000 hours, including more than 75% of classroom hours.

Civil servant as sections of the professional retraining program advanced training programs (internships) can be credited, the development of which is confirmed by state documents received no later than three years before the start of training under the relevant professional retraining program.

The development of educational programs for professional retraining by civil servants ends with a mandatory state final certification, which provides for final qualifying (certification) work and an exam.

Based on the results of the mandatory state final certification, state documents are issued: a diploma of professional retraining, a diploma of additional (to higher) education.

A diploma of additional (to higher) education gives a civil servant the right to apply for filling positions in the civil service, the qualification requirements for which provide for the presence of a higher professional education of the relevant profile.

Requirements for advanced training of civil servants. Professional development is carried out in order to :

    mastering current changes in specific issues of professional activity of civil servants (thematic and problematic conferences and seminars) - from 18 to 72 classroom hours (short-term advanced training);

    comprehensive updating of knowledge on a number of issues in the established area of ​​professional performance to solve the relevant professional tasks - from 73 to 144 classroom hours.

When mastering a professional development program with a volume of more than 72 hours, a civil servant as its sections can be credited with short-term advanced training programs, the development of which is confirmed by state documents received no later than three years before the start of training under the relevant advanced training program.

Advanced training ends with a mandatory state final certification, which provides for the following types of certification tests :

    for short-term advanced training programs - an exam in the form of testing;

    for advanced training programs with a volume of more than 72 hours - an exam in the form of testing and defense of the final work.

Based on the results of the mandatory state final certification, state documents are issued: a certificate of short-term advanced training; certificate of professional development.

Internship requirements. The internship program is developed by the educational institution jointly with the government body whose civil servants are sent for internships, and the government body or other organization hosting the trainees.

Duration of the internship , which is an independent type of additional professional education for civil servants, - two to four months . The duration of an internship that is part of a professional retraining or advanced training program is determined by the curriculum of the respective programs.

The development of an internship program by civil servants, which is an independent type of additional professional education, ends with a report on the internship and a mandatory state final certification, which provides for final qualification (certification) work.

Based on the results of the mandatory state final certification, a state document is issued - a certificate of internship.

Additional professional education of civil servants of other types of public service. Professional retraining, advanced training and internships for civil servants of other types of civil service are regulated by special regulatory legal acts. So, in accordance with the Manual on the organization of professional training of employees of the internal affairs bodies of the Russian Federation, advanced training and professional retraining of the middle, senior and senior commanding staff of the internal affairs bodies takes place in educational institutions of the Ministry of Internal Affairs of Russia, other educational institutions that have licenses and state accreditation; junior, middle and senior commanding staff - in vocational training centers. The rank and file and the commanding staff undergo internships at the place of service, in other internal affairs bodies, federal executive bodies and foreign states (if necessary and in the prescribed manner).

Advanced training includes the following types of training :

    short-term (at least 72 hours) thematic training on specific issues of the operational activities of employees, which ends with passing the appropriate exam, test or defense of the abstract;

    thematic and problematic seminars (from 72 to 100 hours) on legal, operational-technical, forensic, psychological and other problems arising at the level of departments, regions, bodies (divisions, institutions) of internal affairs;

    long-term (over 100 hours) training of specialists in an educational institution of additional professional education for in-depth study of topical issues in the profile of professional activity.

The purpose of professional retraining of employees is to provide them with additional knowledge, skills and abilities in educational programs that provide for the study of certain disciplines, sections of law enforcement and operational-service orientation necessary to perform a new type of professional activity.

Professional retraining of employees is carried out according to curricula and programs that provide for more than 500 hours of study time. Based on the results of professional retraining, employees receive a state diploma certifying their right (qualification) to conduct professional activities in a particular area.

The main purpose of the internship is the formation and consolidation in practice of professional knowledge, skills and abilities obtained as a result of theoretical training.

Training camps in vocational training centers are held, as a rule, in the amount of not less than 72 and not more than 144 hours.

Additional guarantees are provided subject to certain conditions provided for by this Law or other regulatory legal acts of the Russian Federation, laws or other acts of the constituent entity of the Russian Federation.

This approach allows, firstly, to ensure equal conditions for the passage of the civil service, regardless of its level (whether it be the federal civil service or the civil service of a subject of the Federation), departmental affiliation civil servant. Secondly, the necessary prerequisites are being created for the differentiation of measures for the social protection of civil servants, taking into account the nature, characteristics, efficiency and effectiveness of their professional performance, civil service development processes and other conditions.

Under certain conditions, civil servants can be guaranteed:

1. The right to professional retraining, advanced training and internship with the preservation for this period of the civil service position to be replaced and the salary.

In paragraph 3 of Art. 62 of the current Law establishes an exhaustive list of grounds for sending a civil servant for professional retraining, advanced training or internship. These include: the appointment of a civil servant to another civil service position in the order of promotion on a competitive basis; inclusion of a civil servant in the personnel reserve on a competitive basis; results of certification of a civil servant. A civil servant can exercise this right during the entire period of his civil service.

The law establishes a direct dependence of the career growth of a civil servant on the results of additional professional education received by him.

Specific time frames are set for advanced training - as needed, but at least once every three years.

The state also guarantees the direction of a civil servant for an internship. This form of additional professional education for the first time, in the presence of these conditions, becomes mandatory.

positions of the civil service, replaced by civil servants, in the manner determined by the President of the Russian Federation.

In order to effectively implement this guarantee, the Law introduces a unified procedure for state bodies for planning and placing state orders for additional professional education for civil servants. The place for exercising the right to professional retraining and advanced training is established by the Law at educational institutions of higher vocational and secondary vocational education that have state accreditation. Internships are carried out directly in state bodies, as well as in other organizations. A civil servant can also receive additional professional education outside the Russian Federation.

The law obliges the representative of the employer, educational institution, state body or other organization to provide a civil servant undergoing professional retraining, advanced training or internship with appropriate conditions for mastering the educational program.

The organization of professional retraining, advanced training and internships for civil servants is an important element personnel work(clause 13, clause 1, article 44), the implementation of which is carried out on the basis of a state order, formed in accordance with the requirements of art. 63, as well as in accordance with the programs of professional development of civil servants (clause 1, clause 2, article 60 of the current Law).

2. The right to transport services provided in connection with the performance of official duties, depending on the category and group of the civil service position being occupied, as well as compensation for the use of personal transport for official purposes and reimbursement of expenses associated with its use in the cases and in the manner established respectively, the regulatory legal acts of the Russian Federation and the regulatory legal acts of the constituent entity of the Russian Federation.



Reimbursement of expenses for the use of personal transport by an employee with the consent of the employer is provided for in Art. 188 of the Labor Code.

The procedure and conditions for providing this guarantee to civil servants are supposed to be specified by adopting the Decree of the President of the Russian Federation "On the provision of transport services or compensation for the use of personal transport of a federal civil servant in connection with the performance of official duties" and the relevant regulatory legal acts of the subject of the Federation.

3. The right to fill another position in the civil service during the reorganization or liquidation of a state body or the reduction of civil service positions in accordance with Art. 31 of the Federal Law.

The Federal Law “On the Fundamentals of the Civil Service of the Russian Federation” unconditionally guaranteed civil servants in these cases to fill another position, and if employment is impossible, retrain (retrain), leave the Civil Servants in the Register (indicating: in reserve) while maintaining continuous experience for a year public service.

In the current Law, this guarantee is closely linked with Art. 31, which formulates the conditions for filling another position. These include only the possibility of replacing another position with certain advantages or sending a civil servant for professional retraining or advanced training.

4. A one-time subsidy for the purchase of living space once for the entire period of civil service in the manner and on the terms established, respectively, by a decree of the Government of the Russian Federation and regulatory legal acts of a constituent entity of the Russian Federation.

The Federal Law "On the Fundamentals of the Civil Service of the Russian Federation" guaranteed the provision of living space to civil servants in the case and in the manner prescribed by the Federal Law or the law of a constituent entity of the Federation. However, at the federal level, the required act was never adopted. This guarantee was provided on the basis of departmental acts of federal state bodies (for example, order of the State Customs Committee of the Russian Federation dated September 30, 2003 No. 1088 “On the procedure for providing residential premises in customs authorities and institutions under the jurisdiction of the State Customs Committee of Russia”), and in a number of subjects of the Federation - on the basis of the laws of the subjects and directly depended on the financial and organizational capabilities of federal departments and subjects of the Federation. At the same time, the form of its provision was arbitrary (the allocation of apartments, the provision of interest-free subsidies for housing construction, etc.).

The current law establishes a single form for the civil service of providing the specified guarantee - a one-time subsidy once for the entire period of civil service in the manner and on the terms established respectively by the decree of the Government of the Russian Federation and the regulatory legal acts of the subject of the Federation.

5. Other state guarantees.

This norm creates the prerequisites for expanding the system of guarantees for civil servants as the legislation on the civil service develops. In addition, the representative of the employer, based on the possibilities of the relevant budget, has the right to expand the range of guarantees. As an example, we can cite the provisions of the Law of the subject of the Russian Federation “On the State Civil Service of the City of Moscow” No. 3 of January 26, 2005, where the relevant civil servants are additionally guaranteed:

Provision of living space (improvement of living conditions) or compensation of expenses for the purchase of housing;

Free or preferential (including for family members) sanatorium-resort voucher, reimbursement of funds for travel to and from the place of rest;

Compensation for an unused spa voucher;

Medical care (including family members) depending on the category and group of the position;

free vacation medicines, provision of prosthetic and orthopedic care (including family members);

One-time monetary incentive upon reaching the age of 50 years and then every 5 years in the amount of two months' salary for the position held;

One-time monetary incentive upon reaching the experience of 20 years and then every 5 years as part of a two-month salary for the position being replaced;

Payment of a one-time monetary reward upon retirement in the amount of the average monthly wages in multiples of the number of full years of service, but not more than 10 years;

Supplement to the old-age and disability pension in the presence of length of service (12.5 years for men and 10 years for women), so that the amount of the pension is 55% of the monthly allowance with an increase of 3% for each full year of service, but not more than 80% of the monthly monetary content;

Reimbursement of expenses for funeral services to persons carrying out the funeral of a civil servant;

Preservation of a number of state guarantees for retired civil servants;

Preservation of a number of guarantees for civil servants dismissed during the liquidation or reorganization of a state body or the reduction of positions (for men who have reached the age of 58, for women - 53 years).

A public civil servant is different from a person employed by employment contract. He has a special employer - the state. The efficiency of the civil service depends on the professionalism of its employees. Therefore, the rights and obligations of the employer in relation to additional professional education of employees are legally established. In particular, paragraph 6 of part 1 of Art. 15 of the Federal Law of July 27, 2004 N 79-FZ "On the State Civil Service of the Russian Federation" (hereinafter - Law N 79-FZ) stipulates that a civil servant is obliged, among other things, to maintain the level of qualification necessary for the proper performance of official duties.

Additional vocational education is carried out through the implementation of additional professional programs (training programs and professional retraining programs).

The type, form and duration of additional professional education are established by the representative of the employer, depending on the group and category of the civil service position occupied by civil servants, in the manner determined by the Regulation approved by Decree of the President of the Russian Federation of December 28, 2006 N 1474 "On additional professional education of state civil servants of the Russian Federation” (hereinafter referred to as Regulation N 1474). In accordance with this Decree, professional retraining, advanced training and internships for civil servants are carried out in accordance with the State requirements for professional retraining, advanced training and internships for civil servants of the Russian Federation, approved by Decree of the Government of the Russian Federation of 06.05. 2008 N 362 (hereinafter - Requirements N 362).

The grounds for sending a civil servant to additional professional education are:

Additional professional education of a civil servant

is carried out in any form of education provided for by the legislation on education with or without interruption from the performance of official duties in a civil service position to be substituted (part 9 of article 62 of Law N 79-FZ). "

According to Clause 2 of Requirements N 362 professional retraining and advanced training of civil servants are carried out using the possibilities of distance learning technologies, depending on the categories and groups of civil service positions:

-with a separation from the civil service (professional retraining and advanced training outside the territory of the Russian Federation, internships in the territory of the Russian Federation and abroad);

-with a partial separation from the civil service (up to three working days a week);

without interruption (evening groups) from the state civil service of the Russian Federation.

Professional retraining and advanced training of civil

employees outside the normal working hours are carried out in accordance with the legislation of the Russian Federation.

However, at the same time, it is necessary to take into account clause 3 of Requirements No. 362, according to which the total volume of the classroom teaching load of civil servants per week should be:

1. Professional retraining

According to clause 9 of Requirements N 362, as well as clause 4 of Regulation N 1474 under professional retraining of civil civil servants is understood as the acquisition of additional knowledge and skills necessary for the implementation by civil servants of a new type of professional service activity.

That is, the purpose of professional retraining is to perform a new type of professional activity or obtain additional qualifications.

It should be noted that for professional retrainingcivil servants who fill civil service positions of the category "assistant (advisers)", "specialists" or "providing specialists", if they are appointed in the order of promotion to a civil service positioncategory "leaders". In this case, based on the results of professional retraining, employees may be awarded additional qualifications.

At the same time, the need for professional retraining by employees replacing civil service positions of the category “heads”, “assistants (advisers)” or “specialists” belonging to the highest and main groups of positions, as well as positions of the category “providing specialists” belonging to the main group positions, with the assignment of additional qualifications to them is determined by the employer.

For professional retraining, the following terms for mastering educational programs are established:

more than 500 classroom hours for civil servants to perform a new type of professional activity;

more than 1000 hours (of which 75% are classroom hours) to obtain additional qualifications (clause 12 of Requirement N 362).

Upon completion of educational programs for professional retraining, a tactile state final certification is carried out, which provides for final qualification (certification) work and an exam.

Positive results of this certification give the right to receive a diploma:

on professional retraining - to persons who have completed training under a program of more than 500 classroom hours;

on additional (to higher) education - to persons who have completed training in an additional professional educational program to obtain an additional qualification of more than 1000 hours (in this case, a civil servant may apply for filling positions, qualification requirements for which they correspond to the profile of the education received).

2. Professional development

In accordance with clause 17 of Requirements No. 362, advanced training for civil servants is updating the knowledge and improving the skills of civil servants with professional education, due to the increased requirements for their qualifications and the need for them to master new ways of solving professional problems.

3. Internship

According to the Requirements N 362, an internship involves consolidating the theoretical knowledge gained by a civil servant during the development of professional retraining or advanced training programs, and acquiring practical skills and abilities for their effective use in the performance of their duties.
