1. Forwarding driver as an independent qualification is not provided for by the current regulatory documents. There is a qualification of a car driver, confirmed by:

a) the current qualification directory of the professions of workers who are set monthly salaries "(approved by the Decree of the USSR State Committee for Labor, the All-Union Central Council of Trade Unions of February 20, 1984 n 58 / 3-102);

b) Decree of the Ministry of Labor of the Russian Federation of November 10, 1992 N 31 (as amended on November 24, 2008) “On approval of tariff and qualification characteristics for industry-wide professions of workers”;

c) by order of the Ministry of Transport of the Russian Federation of September 28, 2015 N 287 "On approval of professional and qualification requirements to employees of legal entities and individual entrepreneurs engaged in transportation by car and urban ground electric transport.

2. Hiring carried out in the form of wording in the order and subsequent entry in work book with the following content "hired as a driver of a car of 3, 2, 1 classes, or a driver of a car of 4, 5, 6 categories."

Car driver must carry out his activities with the employer on the basis of an employment contract and job description.

3. According to the above documents, it is the responsibility of the driver of the car to safely and professionally drive the vehicle of the appropriate category in various conditions traffic, supply of vehicles for loading and unloading cargo, control over the correct loading, placement and securing of cargo in the car body, etc. But there is no obligation to accept, accompany and hand over the cargo, draw up waybills and other transportation documents.

4. If the employer builds its activities with the involvement of car drivers in freight forwarding duties(acceptance of goods, their safety along the way and delivery of goods to the consignee, execution of consignment notes and various acts), then the post of forwarder driver appears.

4.1. Freight forwarder driver - this is a job as a car driver with a combination of the profession of a freight forwarder. The combination of professions is provided for by the Labor Code of the Russian Federation, Article 60.2. Combining the profession of a car driver with the position of a freight forwarder occurs with the consent of the driver and for an additional fee. A driver who combines the duties of a freight forwarder can simultaneously combine the duties of a loader, also with his consent and with an additional payment.

4.2. The employer draws up labor relations with the driver-forwarder in the form of the conclusion of two contracts:

4.2.1. Employment contract with a car driver.

4.2.2. Contracts on the material responsibility of the driver of the car for the forwarding of the transported cargo and other material assets. The basis for concluding an agreement on liability is the Decree of the Ministry of Labor of the Russian Federation of December 31, 2002 N 85.

4.3. In practice, there may be one labor contract with the driver of the car with the entry into it of records regulating the obligation of the driver to perform forwarding functions.

4.4. The liability of the driver of the car as such, as well as in the case of freight forwarding, is detailed in

4.6. A standard form of an agreement on full collective (team) liability is given in Appendix No. 4 to the above resolution of the Ministry of Labor of the Russian Federation (applied when labor activity collector drivers).

5. Forwarding driver when accompanying cargo or other material assets (hereinafter referred to as “cargo”), it performs the acceptance of cargo according to the bill of lading, the delivery of cargo again according to the bill of lading, ensuring the safety of cargo along the way and delivering documents for the cargo.

5.1. Before the cargo is accepted by the forwarder driver, the consignor forms the piece cargo to be sent in the form of packages. Piece cargoes are tare and bulk, are taken into account when sending cargo by the number of pieces and weight.

The forwarder driver at the place of loading controls the placement of cargo on the vehicle in order to ensure uniform distribution of the mass of the cargo over the entire area of ​​the vehicle or container body. At the same time, larger and heavier loads are placed in the lower part and closer to the longitudinal axis of symmetry of the car body, when loading bulk loads different sizes longer weights are placed in the lower rows. Securing cargo in a vehicle in accordance with the Rules for the carriage of goods by road (paragraph 50 and Appendix No. 7) must be carried out by the consignor, but under the control of the driver.

5.2. If the cargo in covered vehicles and containers is intended for one consignee, the consignor shall seal it. Seals are hung (clause 59 of the Rules for the carriage of goods):

a) for vans or their sections - one seal on the doors;

b) for containers - one seal on the doors;

c) for tanks - on the cover of the hatch and the drain hole, one seal each.

5.3. The driver of the freight forwarder, before sending, signs for the acceptance of the goods in the bill of lading. Instructions for filling out the bill of lading are given in

For cargo in a container, in the event of its removal from the vehicle, the consignor issues an accompanying statement to the driver of the freight forwarder for delivery to the consignee. The forwarder driver signs for receiving the container. The form of the accompanying statement is in Appendix No. 8 of the Rules for the Transportation of Goods.

6. Ensuring the safety of cargo along the way.

6.1. The forwarder driver can perform his functions in two directions.

Firstly, he performs forwarding functions on the instructions of the Carrier ( legal entity or individual entrepreneur). In this case, the carrier is responsible for the safety of the cargo. And as an option, the Carrier can send a guard with the cargo, or it can entrust the freight forwarder driver with ensuring the safety of the cargo. It all depends on the nature of the cargo, the distance of transportation, one or two drivers per flight.

Second. If the driver-forwarder is legally independent (individual entrepreneur) and he concludes a contract for the carriage of goods on his own behalf, then the responsibility for the goods lies with him.

6.2. Rules of conduct for the forwarder's driver during the delivery of goods (on the way). The body of the car with the load must be protected from penetration to it by third parties. Close the passenger door from the inside while driving. Do not take passengers. For recreation, stop at paid parking lots (keep receipts). In the parking lot, if possible, park the car in such a way as to limit access to the load as much as possible (with the back door to the wall, etc.). Do not leave documents for the cargo and the car unattended. If, at the insistence of the traffic police, an inspection of the car and cargo is carried out, then this operation is carried out in the presence of the forwarder's driver and two witnesses with a protocol being drawn up.

7. Forwarding driver upon arrival at the consignee, delivers the goods with the presentation of two copies of the bill of lading. The consignee signs for the delivered cargo, the forwarder driver signs for the delivery of the cargo. One copy of the completed bill of lading remains with the consignee, the second copy of the completed bill of lading - with the driver of the freight forwarder.

8. Forwarding driver in case of violation of the terms of the contract for the carriage of goods (lack of cargo, delay in loading, improper stowage of cargo on the vehicle, which caused an unscheduled stop, etc.), makes an appropriate entry in section 17 of the waybill. In case of loss or shortage of cargo, as well as damage (spoilage) of cargo, the driver-forwarder participates in the preparation of the relevant act, if he has received authority for this from his management or he is individual entrepreneur. 1. GENERAL PROVISIONS

1.1. The loader-forwarder belongs to the category of technical performers.

1.2. A person with an average professional education and at least 1 year of experience in the position of a loader-forwarding agent or a similar position.

1.3. The loader-forwarder is appointed to the position with the obligatory conclusion of the Agreement on full individual liability and is dismissed from the position in the established current labor law by order Director General enterprises.

1.5. The loader-forwarder reports directly to the Head of the transport and storage facilities.

1.6. During the period of temporary absence of the Freight Forwarder (business trip, vacation, illness, etc.), his duties are assigned to a person appointed in the prescribed manner, who acquires the appropriate rights and is responsible for the proper performance of the duties assigned to him.

2. JOB RESPONSIBILITIES

Freight Forwarder:

2.1. Carries out loading, transportation, transfer and unloading of intra-warehouse cargo and other inventory items, its sorting, packing manually and using the simplest loading and unloading devices;

2.2. Rolls up and rolls carts with various cargoes to containers, cars or wagons for loading and unloading operations, directly carries out these works;

2.3. Opens and closes the doors of warehouses and containers before and after loading and unloading operations;

2.4. Installs lifting blocks, winches and temporary ramps for loading and unloading operations, assemble them after work is completed;

2.5. Places and strengthens goods in warehouses and on vehicles during transportation.

2.6. Follows the instructions of the management in strict accordance with the instructions received and in compliance with the safety regulations.

2.7. accepts goods from warehouses in accordance with accompanying documents.

2.8. Accompanies goods to their destination, provides the necessary storage mode, safety during transportation.

2.9. Hands over the delivered cargo, draws up acceptance documentation.

2.10. Checks the integrity of the packaging (tare) and compliance of their internal content with the label (marking) during the receipt of products, shipment of products to customers and during inventory.

2.11. Correctly places the cargo, preventing damage and damage to the loaded vehicles.

2.12. participates in the rational and correct placement of goods in warehouses in strict accordance with the instructions of the storekeeper.

2.13. Monitors the correct completion of the shipped goods with accessories, fittings, fasteners, brackets, etc. Immediately informs the storekeeper about the noticed shortcomings.

2.14. Cleans workplaces, warehouses and areas adjacent to warehouses.

2.15. Complies with internal labor regulations.

2.16. Carries out other orders of the management.

3. RIGHTS

The freight forwarder has the right:

3.1. Get acquainted with the draft decisions of the General Director of the enterprise regarding the activities of the warehouse.

3.2. Submit proposals for the improvement of the warehouse operation for consideration by the General Director of the enterprise.

3.3. Request personally or on behalf of the management of the enterprise from the heads of departments and specialists information and documents necessary for the performance of their duties.

3.4. Require the management of the enterprise to assist in the performance of their duties and rights.

4. RESPONSIBILITY

The freight forwarder is responsible for:

4.1. For improper performance and / or non-performance of their official duties provided for by this job description - within the limits determined by the current Labor Code Russian Federation.

4.2. For offenses committed in the course of carrying out their activities - within the limits determined by the current administrative, criminal and civil legislation of the Russian Federation.

4.3. For causing material damage– within the limits determined by the current labor and civil legislation of the Russian Federation.

4.4. For results and efficiency production activities warehouses.

4.5. For false information about the status of the work.

4.6. For failure to comply with orders, orders and instructions from the management of the enterprise.

The qualification directory of the positions of managers, specialists and other employees is a regulatory document developed by the Institute of Labor and approved by the Decree of the Ministry of Labor of Russia of August 21, 1998 N 37. This publication includes additions made by decrees of the Ministry of Labor of Russia of December 24, 1998 N 52, dated February 22, 1999 N 3, January 21, 2000 N 7, August 4, 2000 N 57, April 20, 2001 N 35, May 31, 2002 and June 20, 2002 N 44. General provisions

1. The qualification directory of positions of managers, specialists and other employees (technical performers) is intended to address issues related to regulation labor relations, providing effective system personnel management at enterprises * (1), in institutions and organizations of various sectors of the economy, regardless of ownership and organizational and legal forms of activity.

The qualification characteristics included in this edition of the Handbook are regulatory documents designed to justify the rational division and organization of labor, the correct selection, placement and use of personnel, ensuring unity in determining the duties of employees and the qualification requirements for them, as well as decisions made on compliance positions held during the certification of managers and specialists.

2. The construction of the Directory is based on the job description, since the requirements for the qualifications of employees are determined by their job responsibilities, which, in turn, determine the names of the positions.

The directory was developed in accordance with the accepted classification of employees into three categories: managers, specialists and other employees (technical performers). The assignment of employees to categories is carried out depending on the nature of the predominantly performed work that makes up the content of the employee's work (organizational-administrative, analytical-constructive, information-technical).

The names of the positions of employees, the qualification characteristics of which are included in the Directory, are established in accordance with the All-Russian Classifier of Occupations of Workers, Positions of Employees and tariff categories OK-016-94 (OKPDTR), put into effect on January 1, 1996

3. The qualification guide contains two sections. The first section provides the qualification characteristics of industry-wide positions of managers, specialists and other employees (technical performers), which are widespread in enterprises, institutions and organizations, primarily in the manufacturing sectors of the economy, including those on budget financing. The second section contains the qualification characteristics of the positions of employees employed in research institutions, design, technological, design and survey organizations, as well as editorial and publishing divisions.

4. Qualification characteristics in enterprises, institutions and organizations can be used as normative documents direct action or serve as the basis for the development of internal organizational and administrative documents - job descriptions containing a specific list of job duties of employees, taking into account the characteristics of the organization of production, labor and management, as well as their rights and responsibilities. If necessary, the duties included in the description of a particular position can be distributed among several performers.

Since the qualification characteristics apply to employees of enterprises, institutions and organizations, regardless of their industry affiliation and departmental subordination, they present the most typical work for each position. Therefore, when developing job descriptions, it is allowed to clarify the list of works that are characteristic of the corresponding position in specific organizational and technical conditions, and the requirements for the necessary special training of employees are established.

In the process of organizational, technical and economic development, development of modern management technologies, introduction of the latest technical means, carrying out measures to improve the organization and increase labor efficiency, it is possible to expand the range of duties of employees in comparison with the established corresponding characteristics. In these cases, without changing the official name, the employee may be entrusted with the performance of duties stipulated by the characteristics of other positions, similar in content to work, equal in complexity, the performance of which does not require a different specialty and qualifications.

5. Qualification characteristics of each position has three sections.

The section "Responsibilities" sets out the main labor functions, which can be entrusted in whole or in part to the employee holding this position, taking into account the technological homogeneity and interconnectedness of work, allowing for optimal specialization of employees.

The "Must Know" section contains the basic requirements for an employee with regard to special knowledge, as well as knowledge of legislative and regulatory legal acts, regulations, instructions and other guidance materials, methods and means that the employee must apply in the performance of job duties.

The "Qualification Requirements" section defines the level of professional training of the employee necessary to perform the prescribed job duties, and the requirements for work experience. The levels of required vocational training are given in accordance with the Law of the Russian Federation "On Education".

6. In the characteristics of the positions of specialists, within the same position without changing its name, an intra-position qualification categorization for remuneration is provided.

Qualification categories for remuneration of specialists are established by the head of the enterprise, institution, organization. This takes into account the degree of independence of the employee in the performance of official duties, his responsibility for decisions, attitude to work, efficiency and quality of work, as well as professional knowledge, experience. practical activities, determined by the work experience in the specialty, etc.

7. The Directory does not include the qualification characteristics of secondary positions (senior and leading specialists, as well as deputy heads of departments). The duties of these employees, the requirements for their knowledge and qualifications are determined on the basis of the characteristics of the corresponding basic positions contained in the Directory.

The issue of the distribution of duties of deputy heads of enterprises, institutions and organizations is decided on the basis of internal organizational and administrative documents.

The use of the official title "senior" is possible provided that the employee, along with the fulfillment of the duties stipulated by the position held, manages the executors subordinate to him. The position of "senior" can be established as an exception and in the absence of performers in the direct subordination of the employee, if he is entrusted with the functions of management independent site work. For positions of specialists for which qualification categories are provided, the official title "senior" is not applied. In these cases, the functions of managing subordinate performers are assigned to specialist I qualification category.

The job responsibilities of the "leaders" are established on the basis of the characteristics of the respective positions of specialists. In addition, they are entrusted with the functions of a manager and a responsible executor of work in one of the areas of activity of an enterprise, institution, organization or their structural divisions or responsibilities for coordination and methodological leadership of groups of performers created in departments (bureaus), taking into account the rational division of labor in specific organizational and technical conditions. The requirements for the required work experience are increased by 2-3 years compared to those provided for specialists of the first qualification category. Job responsibilities, knowledge requirements and qualifications of deputy heads of structural units are determined on the basis of the characteristics of the respective positions of heads.

The qualification characteristics of the positions of heads (heads) of departments serve as the basis for determining the job responsibilities, knowledge requirements and qualifications of the heads of the relevant bureaus when they are created instead of functional departments (taking into account industry specifics).

8. Compliance of actually performed duties and qualifications of employees with the requirements job descriptions determined by the certification committee according to current regulation about the certification process. 9. The need to ensure the safety of life and health of workers in the course of work puts forward the problems of labor protection and environment among urgent social tasks, the solution of which is directly related to the observance by managers and each employee of an enterprise, institution, organization of existing legislative, intersectoral and other regulatory legal acts on labor protection, environmental standards and regulations.

In this regard, the official duties of employees (managers, specialists and technical performers), along with the performance of the functions provided for by the relevant qualification characteristics of the position, provide for mandatory compliance with labor protection requirements at each workplace, and the official duties of managers - ensuring healthy and safe working conditions for subordinate performers, as well as monitoring their compliance with the requirements of legislative and regulatory legal acts on labor protection.

When appointing to a position, it is necessary to take into account the requirements for the employee to know the relevant labor safety standards, environmental legislation, norms, rules and instructions for labor protection, means of collective and individual protection against the effects of hazardous and harmful production factors.

10. Persons who do not have special training or work experience established by the qualification requirements, but who have sufficient practical experience and perform qualitatively and in full the tasks assigned to them official duties, by recommendation attestation commission as an exception, they can be appointed to the relevant positions in the same way as persons with special training and work experience.

Job responsibilities. Qualification requirements.

Transport forwarder of category I - higher professional (technical or economic) education and work experience as a transport forwarder of category II for at least 3 years; owning at least one foreign language at a level that ensures professional communication with foreign partners; additional education with the qualification "Transport Forwarder".
