When moving, transporting goods across the border, a huge package of documents is required. One of the required papers is a consignment note of a special form CMR. We will try to consider further how this document is compiled, what information it contains, how to draw it up correctly.

CMR - what is it?

The international consignment note CMR is a document proving the conclusion of a contract for the transportation of products by road.

This document contains information about:

  • about the sender of the goods;
  • about the addressee of the cargo;
  • the origin of the delivered goods;
  • about the location of the delivery;
  • about the method of transportation;
  • about the proper itinerary;
  • about the name of the goods, indicating the weight;
  • as well as shipping costs.

The international waybill CMR is a document proving the conclusion of an agreement for the road transport of products

The consignment note is a unified document issued when moving inventory items (products) using vehicles.

The main purpose of this document: having issued it, the seller (supplier) has the right to write off the goods from his warehouse, and the buyer gets the right to capitalize them. In addition, in the absence of an agreement concluded between the parties for the provision of services for the transportation of goods, the consignment note may indicate its presence or even replace it.

As a rule, the specified paper must be drawn up in several copies, each type of invoice has its own quantity.

In addition, this document is subject to mandatory certification by all parties involved in the process of product delivery.

The CMR bill of lading is used only when products are transported across the border.

What is CMR is well explained by the decoding of the abbreviation of this concept (pronounced “CMR”), which means the abbreviated name from the full one - the Convention on the International Carriage of Goods by Road.

The CMR waybill is considered a paper of international importance, therefore, it must be filled out and drawn up strictly according to the rules, in order to avoid legal problems during the transportation of goods, as well as its receipt.

What information is entered in the CMR

The CMR invoice may cover the following data:

  1. Place, date of registration.
  2. Name and address of the sender.
  3. Name, address of the carrier.
  4. Date, place of transfer (acceptance) of products for shipment.
  5. Place of delivery.
  6. Name and address of the host.
  7. The name of the product, indicating its established designation, type of packaging. If you have to move dangerous goods - their generally recognized labeling.
  8. The number of packages in a vehicle unit. If necessary, special marking with the assignment of numbers.
  9. Product weight. Gross is indicated, that is, weight together with tare (packing) or other units of measurement.
  10. The amount of costs associated with transportation. This may include:
  • customs duties;
  • transportation cost;
  • additional costs associated with the movement of goods.
  1. Various instructions for customs clearance.

In addition to the above, the following information is allowed in the text of the document:

  1. A direct ban on reloading products into another unit of transport.
  2. Expenses that are subject to reimbursement at the expense of the sender.
  3. Cash on delivery for products, which is withdrawn upon receipt.
  4. Documentation containing information regarding full cost goods.
  5. Information regarding the amount of insurance for the transported products.
  6. Directions additional term delivery.
  7. Fixing the list of documents submitted for transportation.

The specified information is not exhaustive, by agreement between the parties, it is allowed to record other information recognized by them as necessary.

How to fill out the CMR

This document is a unified form, consisting of six or more pages.

Each individual attribute to be filled in is indicated in Russian and German.

If for several recipients, you should fill out a separate CMR invoice for each such recipient. Accordingly, if the transported products will be moved using several vehicles, the specified document must be issued for each unit of transport.

The number of copies of the consignment note must be drawn up in such a quantity that international transportation is carried out without problems, namely:

  1. The sender of the cargo is entitled to one copy.
  2. The second copy of the CMR waybill is subject to transfer to the recipient of the goods.
  3. Two other copies must be issued to the carrier. One of which goes to confirm the fact of the provision of delivery services, which means, as a result, the need for payment, making mutual settlements. And the second document is stored for accounting purposes, that is, it is attached to the waybill.
  4. For the customs authorities, it will be necessary to issue at least three copies. Moreover, it will be enough for them to be certified by signatures, seals both from the side of the customer (sender) and from the side of the carrier.

The number of copies of the waybill must be drawn up in such a quantity that international transportation is carried out without problems

The use of this document is intended for the transportation of goods starting from the territory of the Republic of Belarus. However, the use of this form of waybill is also acceptable when sending from the territory of other states.

The invoice must be certified by signatures of responsible persons, as well as seals (stamps) of enterprises.

The carrier, accepting goods for movement, must properly inspect and check the number of places, labeling, product condition, type of packaging. If everything meets (does not meet) the stated requirements, then appropriate marks are put.

CMR form

The procedure for filling out the invoice is prescribed in the Letter of the Federal Customs Service of Russia dated 02.05.2012 No. 04-30/22006 “On sending information”, which contains detailed Instructions.

So, in order:

  1. 1 point, information is entered regarding the sender of the goods, namely:
  • Business name;
  • address;
  • country;
  • contact number of the person responsible for transportation in case of unforeseen situations.
  • FULL NAME. responsible person.
  1. Item 2 should reflect information regarding the recipient:
  • company name;
  • address;
  • country;
  • in addition, it is mandatory to indicate a person who can coordinate traffic when entering the country, as well as solve all the necessary issues;
  • FULL NAME. connected person.
  1. Item 3 contains information regarding the address of the place of unloading, as well as the name of the country.
  2. 4 point: it is necessary to indicate the time, date and place of loading of products.
  3. Clause 5 should contain information about the documentation that is the application, for example:
  • invoice;
  • goods loading scheme;
  • act of loading;
  • quality certificates;
  • quarantine certificates;
  • other documents regarding the transported cargo.
  1. 6 point: information regarding dangerous goods (class, subclass) is prescribed.
  2. Data on indicating the number of seats - point 7.
  3. Paragraph 8 covers data regarding the type of packaging.
  4. The name of the cargo is written in paragraph 9.
  5. Clause 10 contains a special code for the transported goods, in accordance with the FEACN of the Customs Union.
  6. The weight of the cargo, taking into account the packaging, should be indicated in this paragraph.
  7. The volume of production (cubic meters) contains paragraph 12.
  8. In this paragraph, information should be entered regarding the customs authority where all necessary actions will be performed.
  9. Item 14 contains the trailer number.

It should be noted that the shipper must fill out this document, and, accordingly, all costs and losses that the carrier may incur as a result of an incorrectly executed document fall on his shoulders.

  1. Column 15 contains data on payment for goods, in accordance with Incoterms-90.
  2. Column 16 is drawn up by the forwarder, it is permissible to do this with a stamp.
  3. Clause 17 must be drawn up if several carriers are used when moving cargo.
  4. Column 18 should contain the carrier's comments, for example, such as:
  • the cargo is not packed;
  • container is sealed;
  • the goods are frozen (spoiled, etc.);
  • packaging does not meet the requirements;
  • other types of remarks.
  1. Section 19 is only to be completed after delivery has been made and very often is left blank.
  2. A place for special conditions is reserved for paragraph 20.
  3. Section 21 should indicate the place where the CMR invoice was drawn up (locality).
  4. Arrival for loading and departure, reflected in column 22, can be filled in using stamps.
  5. Column 23 is drawn up by the carrier and contains:
  • waybill numbers;
  • driver data;
  • carrier's signature and seal.
  1. Section 24 contains information regarding arrival and departure from unloading.
  2. Columns 25 and 26 contain data on the tractor and semi-trailer:
  • state numbers;
  • brands;
  • models.
  1. The remaining items are filled upon arrival at the forwarder's department.

It should be noted that the shipper must fill out this document, and, accordingly, all costs and losses that the carrier may incur as a result of an incorrectly executed document fall on his shoulders.

In order for this document to be processed promptly, the following procedure should be followed:

  1. The consignor of the cargo draws up the following columns: 1 - 15, 21, 22.
  2. The carrier should pay attention to subparagraphs: 16 - 19, 23, 25, 26, 27 - 29.
  3. The consignee puts his mark in paragraph 24.

The CMR international consignment note is a strictly unified form, which is issued during international transportation. It must be filled out strictly according to the established rules, in order to avoid further questions and problems when moving cargo.

The international commercial carriage of goods by road is governed by the provisions of a special convention of 1956 (Convention on the Contract for the International Carriage of Goods by Road, concluded in Geneva on May 19, 1956). It is followed by many European countries, Eastern states, as well as the Russian Federation. According to the convention, when transporting goods by road, an international consignment note CMR should be drawn up, without which it is impossible to transport any goods across the border.

The CMR invoice performs several functions:

  • CMR is a universal form of shipping documents, it is understandable to all trade workers living in different countries;
  • it marks the transfer of the goods to the forwarder and the acceptance by the recipient when it is delivered. That is, it is easy to establish who and at what point in time is responsible for its safety;
  • The CMR serves as confirmation that the cargo is moving legally. The absence of a CMR can lead to the arrest of the goods being transported and the vehicle by the police;
  • it is used for purposes customs control. The document is a loose-leaf notepad. If the car crosses the border, then the inspector puts the appropriate marks on the CMR. After that, he leaves one sheet at customs, and the car follows on. As a result, with the help of the consignment note, you can trace the entire path of the cargo;
  • issuance of CMR means that the provisions of the convention apply during transportation. They impose certain obligations on the participants in this process, which may not be provided for in the contracts.

The document is drawn up in triplicate, signed by the sender of the goods, as well as by the carrier. Some countries require an additional copy. If the cargo is being carried by several cars, or there are several different cargoes in one car, the number of copies is determined by the number of cars or types of cargo.

Where to get CMR (International Consignment Note)

Unlike Carnet TIR (Transports International Routiers), or in Russian - TIR carnet (international road transport), the form of which is printed and issued by the national guarantee association (abbreviated as ASMAP) in Russia (Customs Convention on the International Carriage of Goods using the carnet TIR, concluded in Geneva on 11/14/1975), the CMR form can be downloaded from the Internet and printed on a printer, like any other waybill.

In what cases is it used

CMR is required when several conditions are met:

  • if remuneration for transportation is provided;
  • places of loading and unloading are located in different countries;
  • The CMR Convention is signed by at least one of the states whose residents are parties to the transaction;
  • transportation is carried out by road transport.

Filling rules

The consignor of the goods must handle the delivery of the invoice. In the required columns, he indicates the following information:

  • 1 - information about the sender;
  • 2 - recipient data;
  • 3 - destination of transportation;
  • 4 - information about the place and date of loading the goods onto the vehicle;
  • 5 - details of the documents attached to the CMR. This is the invoice and packing list. A bill of lading may also be attached;
  • 6 - information about the hazard class assigned to the transported goods. If it does not belong to the category of dangerous during transportation, then nothing needs to be written;
  • 7 and 8 - information on the number and type of packages;
  • 9 - the name of the transported goods. It can be omitted if various goods are being transported. If the cargo is not specified, then it is considered contraband;
  • 10 - nomenclature code assigned to the cargo;
  • 11 - information about the total gross weight;
  • 12 - the number of cubic meters that the transported goods occupy;
  • 13 - about the price of the transported goods, data on the license and other information;
  • 14 - filled in if the goods are transported in a special container. After delivery, the container must be returned to the address indicated in this paragraph;
  • 15 - information about the terms of delivery, in accordance with Incoterms;
  • 16 - information about the carrier;
  • 18 — marks of the carrier about the accepted cargo;
  • 19 - settlements after the completion of transportation;
  • 20 - special conditions of transportation that are important for the safety of the goods;
  • 21 - date of preparation of the document;
  • 22 is the time of arrival for loading and the time of departure of the transport;
  • 23 - information about the driver (full name, number of the waybill). The stamp of the carrier organization is put here;
  • 24 - mark of the recipient on the acceptance of the goods;
  • 25 and 26 - about the registration numbers of the car and trailer, as well as about the make of the vehicle;
  • 27-29 - are intended for entering additional information into the invoice.

The driver of the vehicle in which the cargo will be transported is given an almost completed form. It also contains the seal of the sender of the cargo and the signature of the official.

There is no clear indication of the language in which the document should be filled out. The official language of the country in which the vehicle is registered is usually used. But if the cargo is sent to European or Asian countries, then it is better to use English.

There are several mandatory stamps that must be included in the CMR. This is, first of all, the seal of the recipient, which is placed at the end of the transportation of the cargo. In addition, at the customs it is necessary to put a seal at the border and during customs clearance in the place where it will be carried out. These seals indicate that the goods have entered customs and that their release from customs is allowed. There is also a place for printing delivery control, when passing through several customs, they serve to set the time of arrival of the goods at the post.

Russian manufacturers continue to develop international market despite the imposition of sanctions. For the importation of goods into the territory of another state, in addition to customs declaration, you need to draw up an international CMR waybill. The document is drawn up for international cargo transportation by car.

Application conditions

An accompanying document is issued if the country of the sender or recipient has ratified the Convention of 05/19/1956 regarding the contract on international road transport. The norms of the Convention establish the rules and procedures for transportation by road, including for state (municipal) institutions (clause 3, article 1 of the Convention).

The current conditions do not apply to transport:

  • postal goods, as they are regulated by international postal conventions;
  • furniture, household appliances, other movable property and utensils when moving (change of residence, location);
  • bodies of deceased relatives, family members.

The CMR waybill form is unified for all states. AT Russian Federation the form and procedure for filling out are regulated by the letter of the Federal Customs Service of Russia dated 02.05.2012 No. 04-30 / 22006.

If the route of cargo transportation passes through the borders of other states, then the presence of the CMR consignment note is mandatory. Otherwise, the transported objects may be arrested, and the sender and carrier may be fined. The amount of penalties is established by the legislation of the country in which the arrest occurred.

How to draw up

The CMR form (international waybill) is drawn up in at least four copies:

  • for the sender;
  • for the recipient;
  • for the carrier company;
  • for calculations.

If you plan to send one order on several vehicles or in several batches, the number of copies may be increased. If the transported goods are intended for several recipient firms, then the CMR is issued for each.

Forms must be signed by the responsible parties by hand or by stamp or facsimile. It is possible to affix seals or facsimile instead of a signature, only if this is not prohibited by the legislation of the sender's country.

Information that must be indicated in the accompanying form:

  1. Place and date of issue of the international waybill.
  2. Place of acceptance of cargo for transportation.
  3. Delivery terms.
  4. Information about the sender, its full name, registration information, legal address.
  5. Similar information about the recipient and transport agent (if any).
  6. Generally accepted data about the product, its packaging, volume, weight, number of seats.
  7. Information that the cargo is transported under the Convention, without derogations and reservations.

By agreement of the parties, the document may indicate Additional Information, for example, identifying the goods, or detailed information about the transport agent.

The rules and conditions for filling out for each of the parties to the transportation are specified in the letter of the Federal Customs Service of Russia dated 02.05.2012 No. 04-30/22006. Consider the basic rules in the form of a table.

The sender fills in columns 1-15, 21-22.

Attached documents

We describe the list of accompanying documents. Here you can specify:

  • invoice (invoice);
  • goods shipment specification;
  • cargo quality certificates industrial production;
  • veterinary certificates for consignments of animal origin;
  • quarantine certificates for consignments of plant origin;
  • certificates of origin (certificate of origin);
  • the act of loading the goods.

Block of information about the cargo/goods

Specify detailed data on the transported cargo (name, number of pieces, type (genus) of packaging, gross weight, volume and TN VED codes). If transported a large number of items, abbreviation is acceptable in the form: decoding in the invoice (invoice). If dangerous goods are being transported, be sure to indicate the hazard class.

Sender's instructions

Here we write down the data of the customs terminal where the cargo should be delivered. In the lower part of the field, indicate the cost of the goods.

We fill in subject to transportation by container. Specify the return location of the container after unloading.

Terms of payment

We prescribe the terms of payment, according to the international supply agreement. We indicate the code according to the Incoterms dictionary.

Carrier

Requisites transport company carrying out cargo transportation. Company seal (or stamp) required.

Subsequent carrier

We fill in if it is planned to reload the goods from one vehicle to another. We prescribe information about the forwarder (agent) that controls the transportation. Agent stamp.

Reservations and remarks of the carrier

Completed by the carrier. Any remarks about the product, its packaging, temperature and speed conditions are indicated here.

Payment Information

To be completed by the billing department after receiving the goods. It is permissible not to fill in this field.

Special agreed terms

We prescribe the special conditions of the transportation agreement (delivery time, insurance conditions, delivery cost, payment terms, etc.).

Place and date of compilation

We prescribe the name of the settlement and the date of issue of the document.

Arrival for loading

Prescribe exact time and the date of arrival of the vehicle for loading and departure from the loading area. We put the seal of the sender and the signature of the responsible person.

Driver information

We prescribe the number of the waybill, the full name of the driver of the vehicle from the carrier. We certify with the seal and signature of the carrier.

Arrival for unloading

We indicate the exact time and date of arrival for unloading, as well as the time of departure from the unloading area. We put the seal of the recipient and the signature of the responsible person.

Information about loading technology

The number, model, brand of the tractor or semi-trailer that loaded the goods is indicated.

Estimated data

It is filled in by the settlement department upon delivery of the invoice to the freight forwarder.

The completion of column 18 should be treated with special attention. If there are no reservations, it is considered that the goods were accepted in good condition, the number of pieces, weight, packaging correspond to those indicated in the invoice. If you do not enter reservations and instructions in the first copy for the shipper, then it will be impossible to prove the discrepancy.

For road freight transportation abroad, customs, in addition to the general package of documents, additionally require a CMR consignment note, which contains all the basic data from other papers: information from invoices, packing lists, various certificates and certificates, etc. This paper is the most significant, it confirms the agreement between the sender, the recipient and the freight forwarder. In order to avoid legal problems, it is extremely important to be able to fill it out correctly.

CMR invoice - what is it and how is it decoded, what information does it include, how is it drawn up and why is it needed?

The abbreviation CMR itself is taken from the name of the convention in French. In Russia, it is translated as CMR - Convention on the contract for the international carriage of goods by road. The convention was held in the city of Geneva in 1956, the agreements themselves acquired significance in 1958.

The bill of lading (CTH) serves as an evidence document confirming the conclusion of an agreement for the carriage of goods by road. The invoice form has a single unified form, is issued when moving valuables using transport.

The use of this document has several purposes, indicating the rights of the supplier to sell the goods, the rights of the buyer to register them as property and replacing the contract for the provision of cargo transportation services or applying as an addition to this agreement. The CMR is only relevant for the transportation of goods abroad. It must be done strictly according to legal rules.

Features of the CMR invoice

The value of SMR is difficult to overestimate. The information that can be obtained from the CMP document is:

  • The number of product units.
  • Transportation route.
  • Who transported the product.
  • Information about accompanying documentation.
  • Name of the addressee and sender.
  • The period of transportation.
  • Customs information.
  • Product condition.
  • Date of loading and unloading.

TTN CMR - what is it? The CMP form contains information from all accompanying documents. It is extremely important that all these data overlap with each other and all information matches. The presence of different information in the CMR and other papers (for example, a packing list or invoice) is fraught with a lot of complications.

The carrier is the most affected. In order to avoid subsequent problems, the forwarder must meticulously, carefully and scrupulously check and verify all forms of documents.

If the consignment note does not indicate the goods, then this product is considered contraband.

The CMP must contain two groups of information:

  1. Basic information containing the basic data necessary for the subsequent transportation of the goods.
  2. Seals, signatures, marks, remarks about the transportation process are another rather significant category.

Each consignment note must have a specific number.

Conditions for using the CMR form

For the Convention to apply in a contract of carriage, the agreement must meet certain conditions:

  • transportation is paid;
  • goods are transported from one state to another;
  • road transport is used for transportation;
  • one of the countries has signed the IDA Convention.

Only in this case, the CMR waybill will be used for the transportation of goods.

Who needs CMR copies?

The CMR form itself is written on several pages. Each of its columns is duplicated twice: in Russian and foreign language. If there are several consignees, a separate CMR sample is required for each of them. Therefore, at least one CMR document is required for each vehicle.

The consignment note must be drawn up in several copies in order to avoid problems during transportation.

  1. The first copy remains with the sender.
  2. Another copy is given to the buyer of the goods.
  3. The carrier of the cargo also needs forms, for him it is necessary to issue two copies. The first one is an addition to the waybill. The second document confirms the very provision of the delivery service, which is extremely important for subsequent payment and settlements.
  4. Customs authorities require a minimum of three copies.

The documents must be signed and stamped by the sender and the carrier. When accepting the goods, the carrier must, in accordance with the established procedure, inspect the number of units of the product, its condition, labeling and type of packaging, and mark the conformity / non-compliance of the goods with the specified requirements.

Registration procedure

Documents must be completed by the consignor. If the form is drawn up incorrectly, all the consequences will fall on his shoulders, the carrier is not responsible for these errors.

For the prompt filling out of the document, it is important to follow a certain procedure for filling out the TTN CRM - this is the following sequence of actions:

  1. The sender should pay attention to subparagraphs 1-15, 21-22.
  2. The carrier draws up columns 16-19, 23, 25-29.
  3. The consignee signs and stamps box 24.

Let's take a closer look at these subsections. The procedure for filling them out is specified in the Letter of the Russian Federation of 2012 “On sending information”.

Guidance on the CMR form and how to properly complete it is provided below.

Registration by the sender

The first paragraph contains all information about the sender, including:

  • Name.
  • Address and country.
  • Contact phone number of the person responsible for the transportation.
  • Responsible person's initials.

The second column should contain information about the recipient, namely:

  • Name of company.
  • Country and address.
  • Name and contact number of the contact person.

The third subparagraph indicates to which country and where exactly the goods are sent.

The fourth column indicates the date and time of loading the goods, as well as the point of departure.

In the fifth column, you must specify data on the accompanying documentation by listing all the attached papers. What exactly should be attributed to SMR? These can be, for example, documents such as certificates, packing list, invoice, certificates, TIR (which is sometimes supplemented by a cargo manifest with more detailed description units of production), etc.

The sixth paragraph indicates the degree of danger of the cargo being transported.

In the seventh subsection, the number of places for each product is recorded, indicating the total.

The eighth paragraph describes the type of container.

In column 9, the name of the goods being transported is written.

In paragraph 10, the product code is indicated, taken from the FEACN of the CU.

In column 11, the gross weight of each product (weight with packaging) and their total weight are written.

Columns 7 - 11 represent a single block, for any of them the rule works: each product in each subparagraph must be indicated separately, since it is problematic to obtain this information from other documents. Therefore, these sections are important to complete correctly.

The volume of all products in cubic meters is recorded in the twelfth paragraph.

The thirteenth column contains all the information about customs authority which will perform the check. These data are not specified in other documents. Therefore, it is desirable that the freight forwarder and the customer discuss the customs address in advance and record this in the CPM document. If there is a mistake in indicating the destination, the redirection procedure will be very exhausting and rather complicated, to the point that the TIR Carnet will have to be rewritten.

In this item, you can also enter, if necessary, information about the cost of products in the currency of the invoice.

In the fourteenth paragraph, the trailer number is written.

All information about payment for the goods must be registered in the fifteenth column.

The twenty-first section states locality- place of registration of the CMR-form.

Arrival for loading and departure is permissible to issue stamps in the twenty-second column. According to article 5 of the CMR, if the sender does not have a seal, then only a signature can be put, formally this will not be considered a violation.

Filling out by forwarder

The carrier also issues a CMR (international waybill), a sample of which, already partially completed, is provided to him by the sender.

In the sixteenth column, all information is indicated by the carrier, sometimes it is enough to put a stamp for this.

The seventeenth paragraph indicates the remaining carriers, if there are several.

The eighteenth column contains the forwarder's remarks regarding the commodity condition of the transported cargo: lack of packaging, spoilage of the goods, the presence of a seal, non-compliance of the container with the requirements, etc.

The nineteenth section is issued only after the delivery has been made.

The twenty-third column contains all data on drivers, waybills and a seal with the forwarder's signature.

The twenty-fifth and twenty-sixth subparagraphs describe the make, model and license plate of the road transport (in particular, the trailer and tractor).

Consignee marks

The twenty-fourth column indicates information about the arrival and departure for unloading. Additionally, the consignee puts his signature and seal. In the CMP form, the values ​​of the remaining columns are filled in by the forwarder after the cargo has been delivered to the required place.

Seals of construction and installation works

The sender's stamp is indicated in column 22, it is put by the enterprise specified in the first subparagraph.
